Our Services

Specialist Guidance Across Social Care

Whether you are a family facing an urgent care decision or a provider seeking compliance support, we offer clear, expert guidance grounded in 20 years of hands-on experience.

We work across four core areas

Social care law is complex, and the systems that govern it can feel impenetrable. Our role is to make them navigable — translating legislation and local authority processes into plain English, and helping you take the right steps with confidence.  Please note, Care Clarity Consulting provides independent social care guidance and navigation support.  We do not provide formal legal advice.

Understanding your rights and options

Families & Care Navigation

When a parent or loved one needs care, families are often thrust into an unfamiliar world of assessments, funding decisions, and legal frameworks — at exactly the moment when they have least capacity to navigate them.

We help families understand what they may be entitled to under the Care Act 2014, how local authority needs assessments work, and what happens when a family disagrees with a council's decision. We can attend meetings, review assessment outcomes, and advise on next steps.

We also support families where a loved one is moving between hospital and care — a transition that is often rushed and poorly explained. We help you ask the right questions and ensure the right processes are followed.

What we cover

  • Care Act 2014 needs assessments, including Carers rights and eligibility
  • Care and support planning
  • How funding and financial assessments work
  • Hospital discharge and transition planning
  • Challenging local authority decisions
  • Hertfordshire-specific processes

Protecting rights, enabling decisions

Mental Capacity & DoLS

The Mental Capacity Act 2005 and Deprivation of Liberty Safeguards (DoLS) are among the most important — and most misunderstood — areas of social care law. Getting them right matters enormously for the people they protect.

We support families in understanding whether a capacity assessment has been carried out correctly, what a best interest decision should involve, and how to raise concerns if they believe a loved one's rights are not being upheld.

For providers, we offer guidance and bespoke training packages on conducting lawful capacity assessments, documenting best interest decisions and keeping a close eye on current and future developments.

What we cover

  • Mental Capacity Act 2005 principles and application
  • Capacity assessment guidance and review
  • Best interest decision-making
  • Navigating ongoing legislative changes and LPS readiness
  • Advocacy and support

Acting with care when it matters most

Safeguarding Guidance

Safeguarding concerns require careful, considered action. Whether you are a family worried about a vulnerable relative, or a provider managing a safeguarding referral, the stakes are high and the processes are not always clear.

We help families understand the safeguarding process — what happens when a concern is raised, what their rights are, and how to engage constructively with a Section 42 enquiry. We can also advise on raising concerns where a family believes a provider is failing to keep someone safe.

For providers, we offer guidance on safeguarding policies, staff training frameworks, and responding to safeguarding referrals in a way that is both legally compliant and person-centred.

What we cover

  • Section 42 safeguarding enquiries
  • Raising and responding to safeguarding concerns
  • Safeguarding Adults Boards and multi-agency working
  • Provider safeguarding policies and procedures
  • Hertfordshire Safeguarding Adults Board processes
  • Serious Adult Reviews and learning

Confident compliance for small providers

Provider Compliance Support

Small care providers in Hertfordshire face the same regulatory demands as large organisations — but with far fewer resources to meet them. We offer practical, proportionate compliance support that helps you focus on delivering excellent care.

We work with registered managers and provider owners to review policies and procedures, prepare for CQC inspections, and address any areas of concern identified in previous reports. Our approach is collaborative and non-judgmental — we are here to help, not to audit.

We also offer ongoing advisory support for providers who want a trusted expert to call on when complex situations arise — whether that is a safeguarding referral, a DoLS application, or a difficult family conversation.

What we cover

  • CQC inspection preparation and support
  • Policy and procedure review
  • Care Act and MCA compliance
  • Safeguarding frameworks and training
  • Ongoing advisory retainer support
  • Hertfordshire local authority liaison
